Trash Can Cheetah Terms & Conditions of Service
This is an agreement between you and Trash Can Cheetah LLC (and its affiliates, “Trash Can Cheetah” or “we”). Before using Trash Can Cheetah, please read these Trash Can Cheetah Terms and Conditions of Service, the Trash Can Cheetah Privacy Notice, the Trash Can Cheetah Recurring Payment Terms and Conditions, and the other applicable rules, policies, and terms posted on the Trash Can Cheetah website or available through your Trash Can Cheetah app (collectively, this “Agreement”). By using Trash Can Cheetah, you agree to be bound by the terms of this Agreement. If you do not accept the terms of this Agreement, then we will not be able to provide our services.
You are agreeing to contract with Trash Can Cheetah LLC to perform the service of taking out and returning your waste and recycling cans at the address specified on the designated day of the week. You agree that this is a monthly Service Contract, and you agree to pay Trash Can Cheetah monthly in advance of the services to be provided for that month. You can cancel the service at any time. We will provide services through the end of the month unless requested otherwise.
For the purposes of these Trash Can Cheetah Terms and Conditions of Service:
“Software” means all software (including any updates or new versions), and any related documentation, that we make available to you for use in connection with Trash Can Cheetah.
“Runners” means persons employed or contracted by Trash Can Cheetah LLC to provide Trash Can Cheetah’s can management service.
Home Access:
By submitting your service subscription request, you are authorizing Trash Can Cheetah and its runners to access your property (or other location) that you designate for the purpose of taking out and returning your waste and recycling cans. By subscribing to our service, you are confirming that you have the right to authorize Trash Can Cheetah and its runners to access the designated property. It is your responsibility to ensure that Trash Can Cheetah or its runners have full access to your waste and recycling cans on the scheduled service dates. Should Trash Can Cheetah or its runners arrive and be unable to provide service due to lack of access, you shall not be entitled to a credit or refund.
Service:
Trash Can Cheetah or its runners will take out your waste and/or recycling cans on your designated trash day(s). After your waste and/or recycling items have been picked up, Trash Can Cheetah will return your cans to the original storage location. You agree that for a flat monthly fee Trash Can Cheetah will take out and return your cans for 2-8 pick-up days per month for a total of 4-16 visits per month.
Service Failure:
In the event that Trash Can Cheetah is unable to perform their services for any reason of their own, each customer affected by this failure of service may or may not be subject to financial compensation via refund. Further details are to be determined by the owners of Trash Can Cheetah under their sole discretion.
Can Access:
You must ensure Trash Can Cheetah or its runners have access to your waste and recycling can on the scheduled service day, including: gate entry codes, lock combinations, garage codes, security guard verification, and pets. If Trash Can Cheetah or its runners are unable to access your waste or recycling cans for any reason, services will not be performed that week and you shall not be entitled to a credit or refund. Trash Can Cheetah reserves the right to decline its service for any reason.
Can Location:
If special instructions are not provided, you must leave your trash can(s) and recycle bin(s) visible and accessible to our runners. If said instructions are not provided, and we can not locate your cans, we will be unable to perform service.
Empty Trash Cans:
Trash Can Cheetah also reserves the right not to perform its service if your trash cans and/or recycle bins do not contain any trash and/or recyclables. You shall not be entitled to a credit or refund.
Holiday Schedule:
Our service will unavoidably be effected by your trash provider(s) holiday schedule. Although we will make every effort to provide service every week, Trash Can Cheetah is not responsible for any cans left unattended on holidays where service on the intended day is not possible.
Pricing:
You agree to pay Trash Can Cheetah the current monthly recurring service fee. Trash Can Cheetah reserves the right to increase or decrease the monthly service fee at any time and at its sole discretion. Price will vary.
Change in Price:
Although Trash Can Cheetah makes every effort to remain as competitive as possible and offer the most reasonable prices, some cost increases to the service provided may be beyond our control. In the event that Trash Can Cheetah changes the monthly service fee, Trash Can Cheetah will provide you with one month written notice of any change. If for any reason the amount of your monthly service fee has not been adjusted (i.e. additional trash cans), Trash Can Cheetah reserves the right to adjust the price accordingly at any time. of your monthly service free to the As always, you have the option to cancel at any time if you do not agree with the change in price. If you choose not to cancel, you will be billed and charged the new recurring monthly service fee.
Billing:
Service is billed on the same day of every month and is billed on a recurring monthly basis to ensure uninterrupted service. Unless a specific request is made to cancel the service, billing will continue on a recurring monthly basis.
Payment Terms:
By accepting these terms and conditions you are electing to enroll in the Trash Can Cheetah Payment Plan and agree to the Trash Can Cheetah Recurring Payment Terms and Conditions. You hereby authorize Trash Can Cheetah to bill and charge the Payment Method and its associated Payment Account that you have specified. Trash Can Cheetah will automatically charge the full amount of Payment to your Payment Method each time your can service renews unless you cancel, according to these terms and conditions.
Pets:
The homeowner/resident is responsible to contain and restrain their pets.
Vehicles:
Trash Can Cheetah will make every effort to place your waste can and recycling with great care to a curbside location for city pick-up. In the event that your vehicle or any other vehicles hit or knock over your waste or recycling, Trash Can Cheetah will not be held responsible in any way for any damage to the vehicle or cans.
Safety Issues:
The homeowner/resident is responsible to maintain code compliance with the city on issues such as fencing and gates, backwash/waste lines and all other applicable safety issues.
Customer Satisfaction:
Our goal is your complete satisfaction. In the event that a job is not satisfactorily completed, it is the customer’s responsibility to notify Trash Can Cheetah within 5 business days (preferably sooner) so that we can look into the matter and resolve it as quickly as possible. Furthermore, it is also the customer’s responsibility to notify Trash Can Cheetah of any and all trash (and/or recycle) schedule changes. For example, if the customer’s trash provider is Waste Management, and their trash day originally falls on a Thursday, if Waste Management notifies them that trash day will be Friday, it is the customer’s responsibility to relay that information to Trash Can Cheetah so that we may still be able to provide service for that week.
Changes to Trash Can Cheetah:
We may change, suspend, limit, or discontinue Trash Can Cheetah, or any part of it, at any time without notice. We may amend any of this Agreement’s terms at our sole discretion by posting the revised terms on the Trash Can Cheetah website. Your continued use of Trash Can Cheetah after the effective date of the revised Agreement constitutes your acceptance of the terms.

Disputes/Binding Arbitration:
Any dispute or claim arising from or relating to this Agreement or Trash Can Cheetah is subject to the binding arbitration, governing law, disclaimer of warranties, limitation of liability, and all other terms in the Trash Can Cheetah Conditions of Use. By using Trash Can Cheetah, you agree to be bound by those terms.
Disclaimer:
Under the terms of this agreement, Trash Can Cheetah will not be held responsible for any damage to your waste or recycling cans. Furthermore, Trash Can Cheetah shall not be responsible for any damage to property due to acts of nature, fire, vandalism, misuse, or abuse. Trash Can Cheetah will not be held responsible for any damage caused to vehicles that may back-up or hit your waste or recycling cans in any way.
Recurring Payments Terms & Conditions:
By accepting these terms and conditions through your election to enroll in our service, you hereby authorize Trash Can Cheetah to bill and charge the Payment Method and its associated Payment Account that you have specified.
Your Trash Can Cheetah service will automatically renew on the same day of every month. Trash Can Cheetah will automatically charge the full amount of Payment to your Payment Method each time your service renews, unless you cancel according to the terms and conditions stated below.
Payments, Payment Account and Payment Method:
You agree that the Payment Method specified by you for automatic Payments to Trash Can Cheetah is, and will continue to be, an account that you own, and that you will maintain sufficient availability under your credit card limit, or sufficient funds in the account linked to your debit card or other mode of payment, as applicable, to make your Payments. The automatic charge to your Payment Method will recur on the same day of every month. If your Payment Account number or Payment Account expiration date changes, you understand and agree that your Payment Method issuer may notify Trash Can Cheetah of such changes in order for Trash Can Cheetah to update your Payment Account information on file and charge automatic Payments to your new Payment Account information.
For customers paying via cash or check, you are required to mail in payment that must be delivered by the billing date of your subscription every month.
Notification of Payments:
You may not receive any receipt of payment emails to your Email Account notifying you that a Payment has been made. You understand and agree that Trash Can Cheetah may not provide you with advance notification before a Payment is charged to your Payment Method.
Current Information:
It is your responsibility to make sure that your Payment Method information and Email Account information are current at all times during the term of your subscription.
Payment Method Declined:
If any Payment charged to your Payment Method is declined, you authorize Trash Can Cheetah to make additional attempts for up to two weeks thereafter to successfully charge your Payment Method, if possible, under such Payment Method. Trash Can Cheetah will contact you so that you can correct the issue or provide another form of payment. If no payment is received within two weeks, your service will be cancelled effective immediately.
Cancellation:
Service may be cancelled at will by either party with an advance notice of 5 business days. Cancellation must be done here or in writing at help@trashcancheetah.com. Service is billed at a monthly price and no partial credit or refund will be made.
For either free trial or paid customers, cancellation of your service must be made 5 business days before the Billing Date, otherwise you may be charged for the following month of service. In the event that you ARE charged for the following month of service, please allow up to 5 business days for Trash Can Cheetah to review your account and provide a refund.
Messaging Terms & Conditions
General
Messages and notifications are outbound via notify@trashcancheetah.com.
By signing up for our service, you agree to receive recurring automated informational and marketing emails from Trash Can Cheetah for Trash Can Cheetah. Automated messages may be sent using an automatic email mass marketing messaging software. Emails from Trash Can Cheetah will be sent to the email address you provided when signing up or any other email address that you designate.
Message frequency varies, and additional email messages may be sent periodically based on your interaction with Trash Can Cheetah. Trash Can Cheetah reserves the right to alter the frequency of messages sent at any time to increase or decrease the total number of sent messages. Trash Can Cheetah also reserves the right to change their email address where messages are sent.
Email Provider:
Trash Can Cheetah is not liable for delayed or undelivered messages caused by uncontrollable circumstances or external factors.
Cancellation:
You can cancel any time by replying with “STOP” on any emails sent by notify@trashcancheetah.com. If you would like to receive messages from Trash Can Cheetah again, please fill out our customer support form here or contact us directly at help@trashcancheetah.com.

Transfer of Number:
You agree that before changing your email address or transferring this address to another individual, you may need to contact help@trashcancheetah.com from the original address. The duty to inform us based on the above events is a condition of using this service to receive messages.

Messaging Terms Changes:
We reserve the right to change or terminate our messaging program at any time. We also reserve the right to update these Messaging Terms at any time. Such changes will be effective immediately upon posting. Your continued enrollment following such changes shall constitute your acceptance of such changes.
